Who is a Contract Labourer?

Rather than hiring housekeeping and security personnel’s directly, an IT company may use a contractor.

This triangular relationship between the principal employer, contractor and contract labourer is governed under the CLRA act.

Applicability of the CLRA Act, 1970

It applies to:

Establishments – to any place where 20 or more than 20 contract workers are employed). It is according to states, every state has different threshold.
Contractors – Any person who employs 20 or more than 20 contract labourers on any day in the preceding 12 months.

There may be some Exemptions that be granted by the government for some industries or establishments, but to regulate and safeguard contract workers’ welfare is the principle of this law.

Registration Process for Employers

It is key responsibility of principal employer who is engaging contract labourers, they must obtain registration under the act. Generally the process involves:

Step-I : Application form:

Fill the form I with the details involving name of establishment, number of contract workers involved, detail of contractor and nature of work, after filling the form submit it to the registering officer of the labour department of the state. Submit Form I to the registering officer of the labour department.

Registration Certificate:

After the approval, certificate is issued by the registering officer (Form II). Your establishment is now authorized to engage contract labours.

Contractor’s License:

From the licensing officer license should be obtain by contractor those are supplying the labours. It should specify the number of labours and employment conditions.

Renewal & Records:

It is duty of employer to maintain the register of wages, work performed and workers. Both license and registration should be renewed periodically.

Employer liable on any failure in license or registration as they are directly employed the labourers.

Rights of Contract Labour

Under the Act and all the related labour laws provide several rights and protections to contract labourers:

Fair Wages

Under the minimum wages act, 1948- There is minimum wages for every sector and no contract worker should be paid less than that. Any failure by the contractor must be compensated by principal employer for paying wages.

Timely Payment

Wages should be timely paid before the expiry of wage period.

Welfare Amenities

Like restrooms, first aid, drinking water, canteens and other basic facilities must be provided by contractors. On failure the responsibility falls on principal employer.

Equal Treatment

Under Equal Remuneration Act, 1976 employer has to equal pay for equal work, irrespective of gender.

Social Security Benefits

Depending on establishment eligibility all the contract workers are covered under Employees’ state Insurance and Employees’ Provident Fund.

Health & Safety

Provisions under the Factories Act, 1948 may extend protection to contract workers as well.

Protection Against Exploitation

If the work is permanent, essential to the business, and typically done by regular employees, the government may outlaw contract labour in some establishment.

The principal employer bears ultimate responsibility, even though contractors are direct employers. Among primary duties are:

Fine up to ₹1,000 or imprisonment up to 3 months or both on engaging with contract labours without license and registrations

Liability for Wages & Benefits

Lability falls on principal employer if the contractor fails to provide the ESI, PF or minimum wages or unable to ensure the welfare services, result in double financial burden.

Risk of “Deemed Employment”

If the work is permanent or the contractor is a mere name lender then the contract labour are direct employees of the principal employers it was held by court.

Industrial Disputes

Under the Industrial Dispute act, 1947 dispute over wage inequality, demand absorption as permanent employee or unfair treatment are adjudicated.

The company reputation and brand image can be hampered by the exploitation of contract workers

Abolition of Contract Labour

If contract workers are working in exploitative conditions government can prohibit it and employer then need to absorb them as permanent employees.

Judicial Perspective

Indian courts are constantly working to prevent exploitation of contract labour, there are few judgements that include that.

Air India Statutory Corporation vs. United Labour Union (1997) – If the contract labour is abolished then the contract worker could claim the absorption in the establishments it was held by Supreme Court.
Steel Authority of India Ltd. vs. National Union Water Front Workers (2001) – Court held that it not mandatory that abolition of contract worker can automatically lead to the absorption of contract workers, but they cannot be denied fair treatment.

There should be due Diligence of Contractors while Verify financial capability, license and should keep record and verify past compliance record before engagement.
There should be agreements that clearly assign responsibilities for wages, benefits, and compliance.
Internal and external audit should be done regularly of ESI & PR deposit, welfare facilities and payrolls.
To address the complaints of contract labours worker grievance redressal should be set up.
There should be limit set on core activities so it should avoid the absorption of contract worker and their exploitations.
Proper registers should be maintain of all the statutory compliance, cooperate with labour inspectors and submit the returns and receipts regularly.
