It’s the 19th of the month. Your accounts person walks in and asks, “Did we file the PF return?” You pause. HR thought finance was doing it. Finance thought HR had it. Nobody knows for sure.

If that sounds like your office, you’re in good company. Most growing businesses in India have been there. Nobody enjoys labour law compliance, but everybody pays when it goes wrong.

In this guide we explain labour law compliance in plain words. No legal jargon. You’ll see what it covers, why it feels so messy, what a mistake can cost, and why more businesses now hand this work to an expert team.

What is labour law compliance in India?

Labour law compliance means following the government’s rules on how you hire, pay and treat your employees, and keeping the papers to prove it.

Paying salaries correctly is only half the job. You also have to register your business with the right offices, pay contributions on time, file returns, maintain registers, and keep everything ready for the day an inspector walks in.

So it comes down to two things: do it right, and be able to show that you did.

Why does it feel so confusing?

Because it is confusing. Here are the main reasons.

1. Both the Centre and the states make rules. Labour is a shared subject in India. The central government sets some rules, and each state adds or changes its own. A rule that applies to your head office may work differently for your warehouse in another state.

2. The laws are changing. India has been merging many old labour laws into four new Labour Codes: the Code on Wages, the Industrial Relations Code, the Code on Social Security, and the Occupational Safety, Health and Working Conditions Code. The Government says they came into effect on 21 November 2025. But states are putting their own rules in place at different speeds, so the ground keeps shifting.

3. Every industry is different. A factory and a restaurant don’t follow the same rules, and contract workers come with rules of their own.

4. The deadlines keep coming. Some filings are monthly, some quarterly, some yearly. Miss one and the trouble starts.

What does labour law compliance include?

It depends on your business size, your industry and where you work. But most companies deal with some mix of these:

• Shop and establishment registration

• Provident Fund (PF) and Employee State Insurance (ESI) payments and returns

• Professional tax and Labour Welfare Fund filings

• Minimum wage, bonus and gratuity rules

• Contractor licences and factory licences

• Registers and wage records

• Renewals and inspection readiness

Now picture tracking all of this across five states and 300 employees, using spreadsheets and email reminders. That’s where things start to slip.

Quick reference: who governs what, and what can go wrong

Area	Where the rules sit	How often	What can go wrong
Wages and payroll	Code on Wages (minimum wages, payment of wages, bonus)	Every month	Underpayment claims, back-wages, penalties
PF, ESI and gratuity	Code on Social Security	PF and ESI monthly, gratuity when it falls due	Recovery demands with interest and damages
Shop and establishment registration	State shops and establishment rules	At registration, then renewal as per your state	Notices and penalties under state rules
Contractor licences, factory licences and safety	Occupational Safety, Health and Working Conditions Code	Renewal as per each licence	Inspection notices and penalties
Professional tax and Labour Welfare Fund	State laws	As per your state (monthly, half-yearly or yearly)	State penalties and interest

Rules and due dates vary by state, so check your own state’s position.

What do the new Labour Codes mean for your business?

India has merged 29 central labour laws into four Labour Codes: the Code on Wages, the Industrial Relations Code, the Code on Social Security, and the Occupational Safety, Health and Working Conditions Code. The Government brought them into force on 21 November 2025.

There’s a catch. Labour is a shared subject, so each state also has to notify its own rules, and some states are further ahead than others. Rules are still being published, so the picture changes almost every month.

For your business, this could mean:

• Forms, registers and return formats may change.

• Your offices in two states may follow slightly different rules.

• Wages, social security, contract labour and safety duties may all be affected.

Don’t wait for everything to settle. Find out which Code and which state rules apply to you, and have your payroll and records checked against them now.

What happens if you get it wrong?

This is the part where most business owners sit up.

• Penalties and fines. Late or wrong filings can bring penalties and interest.

• Legal trouble. Repeated misses can lead to notices and cases.

• A bad inspection. If an inspector asks for a register and you can’t find it, that’s a problem, even if everything else is fine.

• A damaged name. Clients and big companies now check whether their vendors are compliant.

• Unhappy employees. If PF isn’t deposited properly, your people feel it, and trust goes quickly.

Most of these problems come from small, avoidable misses, not from bad intent.

Small payroll mistakes are the easiest to miss and the costliest to fix later. Here is a real example.

Real client story: 10 warehouses, two payroll mistakes nobody noticed

Client name withheld for confidentiality.

A logistics company with 10 warehouses was running payroll the same way at every site, and everyone assumed it was right. When Praans Consultech’s team looked at how salaries were being handled, two things stood out:

• ESI was being deducted on the gross salary.

• PF was not being deducted on the special allowance.

Why does that matter? ESI should be worked out on the wages the rules count, and only for employees who are eligible. PF is tied to the wage definition too. Under the new Labour Codes, when allowances and other excluded items make up more than half of total pay, the extra amount can count as wages for contributions. When the same practice runs across 10 warehouses for months, a small error turns into a big back-payment problem.

Praans Consultech’s team corrected the way ESI and PF were being calculated and brought the deductions in line with the rules across all 10 warehouses. Checks were then set up to run every month, so the same mistake could not creep back in.

The result: the company avoided a PF and ESI recovery demand for the unpaid dues. That matters a lot, because under the PF and ESI rules, late or short contributions can attract interest of 12% per year, plus damages of up to 100% of the unpaid amount. In the worst case, a company can end up paying double what it originally owed, before the interest is even counted. By fixing the problem early, the company dealt with it on its own terms instead of waiting for a recovery notice.

The lesson is simple: have an expert check how salaries are structured before a wrong deduction becomes a habit.

What is compliance outsourcing?

Labour law compliance outsourcing means handing your registrations, filings, record-keeping and legal tracking to a specialist team.

Think of how you use a chartered accountant for taxes. You don’t learn every tax rule yourself. This works the same way. You run the business. The experts handle the paperwork, the deadlines and the changes in law.

How Praans Consultech helps

Praans Consultech handles labour law compliance across India, from the day you start up to the day you run offices in many states. Here is what that looks like day to day.

One team for all of India. If you have sites in more than one state, you don’t need a separate person in each one. Praans Consultech looks after central and state labour laws from one place, so every location follows the same process.

Filings done on time. Returns, forms and digital registers are taken care of. When a rule changes, you hear about it before you’ve missed anything.

Ready for audits and inspections. Your registers and records stay up to date. If an inspection happens, a team member can be there with you on the ground.

Saves time and money. Your HR and legal people stop chasing forms and go back to hiring, training and growing the business. Fewer penalties also means fewer nasty surprises.

People who know your industry. The rules for a warehouse are not the rules for a school or a hospital. The team knows the difference, so the advice fits how your business really works.

Software that keeps you in control

Many owners don’t want to hand everything over and then sit in the dark. They want to see what’s going on. That’s why Praans Consultech pairs its expert team with AI-enabled compliance software. Here’s what you get:

• One dashboard showing the compliance status of every location

• Automatic alerts for renewals, payments, inspections and returns

• Real-time updates on labour law changes and government notifications

• Safe digital storage for registers, receipts and audit documents

So you get people who understand the law and a tool that shows you everything.

Almost any business with employees. Praans Consultech works with manufacturing units, logistics and warehousing, retail and e-commerce, IT and BPO, healthcare, construction, hotels and restaurants, education, banking and finance, and staffing companies, among others. It isn’t only for big corporates. Start-ups and growing companies get the same care as large multi-location groups.

Who is behind it?

Compliance is about trust, so it’s fair to ask who you’re trusting.

5 signs it’s time to get help

Be honest with yourself. If two or more of these sound like you, outsourcing could save you a lot of trouble:

1. You’re not sure which laws apply to your business.

2. One person handles compliance, and if they leave, nobody knows what to do.

3. You work in more than one state, or you use contract workers.

4. You’ve had a notice, or paid a late fee, in the past year.

5. The thought of an inspection makes you nervous.

Not sure? Our free Labour Law Compliance Health Check takes about 10 minutes and shows you where the gaps are.

How to get started

It’s easier than most people expect.

1. Talk to the team. Book a free consultation. It’s a conversation, not a sales pitch.

2. Share your situation. Tell them about your business, your locations and your headcount.

3. Get a plan that fits. You get a compliance plan built around your business, not a one-size-fits-all package.

After that, the team takes over the daily work, and you can see everything on the dashboard.

What does it cost?

There’s no single price, because every business is different. The cost usually depends on how many employees you have, how many states you work in, and which services you need. Praans Consultech offers affordable plans for everyone from start-ups to large multi-location companies, and the free consultation gives you a clear idea of the cost before you commit to anything. Compared with one penalty or one failed inspection, it’s often a small number.
