Objective:

It aims to regulate the working conditions in shops and commercial establishments Assam. Its provisions like standardized working hours, regulating overtime, rest intervals and weekly holidays, employee’s rights and mechanisms for registration, inspection and compliance enforcements.

Applicability

All the shops and establishments employing 5 or more the number of employees is required to register and comply with the act’s provisions. Shops and establishment for less than 5 workers shall give an intimation slip.

1. Mandated registration of all establishments and shops

2. Hours of Opening and closing, working hours, rest intervals, weekly holidays, annual leaves and overtime rules

3. Inspection and enforcement authority powers and procedures

4. Procedure Maintenance of records

5. Penalties on non-compliance and violations

6. Maternity benefits and other benefits for employees

7. Prohibition of child labour and working conditions of women

Penalties and Compliance

1. Any violation under this act lead to fine up to Rs. 50,000/- or 6-month imprisonment or both.

2. Continuous or subsequent offence may result in Rs. 2000 per day.

3. Violation cause of accidents may lead to fine up to 1 lakh to 2 lakh with 6-month imprisonment.

4. For any hindrance to the inspector lead to fine up to Rs. 2 lakhs.

5. Employer should register within 60 days.

6. Employer should maintain the register of wages, leaves and attendance.
