Applicability

Code on Social Security (Jammu and Kashmir) Rules, 2020 apply to all establishments, employers, employees, and workers located in Jammu and Kashmir that fall under the Code on Social Security, 2020. These rules cover organised, unorganised, gig and platform workers, and apply to establishments responsible for EPF, ESI, gratuity, maternity benefit, insurance, and other social security schemes. They apply from the date of their publication in the Jammu and Kashmir Official Gazette.

Key Implementation and Guidelines

1. Mandatory registration of workers, maintenance of records, and timely deposit of contributions on online platforms.

2. Employers must deposit statutory contributions (EPF/ESI etc.) within the prescribed timelines.

3. Requirement to maintain digital records registers and returns in the prescribed formats.

4. Employers must submit details of unorganised, gig and platform workers to enable social security scheme coverage.

5. In Jammu and Kashmir state social security board is established to implement and plan welfare schemes in the state.

6. Enhance the transparency and smooth administration by online filing and compliance.

7. Inspector-cum-Facilitators may conduct inspections physically or electronically for monitoring compliance.

8. Migrant and unorganised workers must be enrolled through Aadhaar-linked registration for portability of benefits.
