A worker must be 18 to 60 years old with at least 90 days of construction work in the preceding 12 months, registered with Aadhaar seeding.
Register of Women Employees Rule 91
Mandatory at every establishment employing women, and must be preserved for three years.
Repeal of Older Rules Rule 99

Applicability

Who the Code covers, and who gets special or exempt treatment.

Covered

  • Employees and workers — regular, fixed-term and unorganised/building workers — in establishments to which the Code on Social Security, 2020 applies in Goa.
  • Fixed-term employees become eligible for gratuity after completing just one year of continuous service.
  • Women employees of covered establishments are entitled to maternity benefit, medical bonus and crèche facility or allowance.
  • Building workers aged 18 to 60 with at least 90 days of construction work in the preceding 12 months qualify for registration and welfare benefits.
  • All public sector establishments must report vacancies to the concerned Career Centre.
  • Employers and contractors undertaking building or other construction work in Goa must self-assess and pay cess.

Exempted / special treatment

  • Vacancies excluded under Section 140(1) and (2) of the Code ('excluded vacancies') are kept outside the Employment Exchange reporting requirement (Chapter VIII).
  • Reimbursement of medical expenses, stock option benefits, crèche allowance, telephone/internet reimbursement and the value of meal vouchers are excluded while computing 'wages' for gratuity (Rule 68, Explanation).
  • Employers who already provide free pre-natal, confinement and post-natal care are exempted from paying the separate medical bonus.
  • Workers below 18, above 60, or with fewer than 90 qualifying days in the preceding year are not eligible for registration under Rule 87.
  • Private sector establishments with fewer than 20 employees fall outside the reporting requirement, unless separately notified by the Government.
  • For Government or Public Sector Undertaking works, cess is deducted at source from the payment bill instead of being self-assessed and paid by the employer.

What is the Goa Social Security Rules, 2026?

It is a set of draft state-level rules framed by the Labour Department, Government of Goa, under the central Code on Social Security, 2020. It covers gratuity, maternity benefit, employee's compensation, Employees Insurance Court procedure, and building and construction worker welfare in Goa.

Are these Rules already in force?

No. As published, they are draft rules open for public objections and suggestions. They will come into force only from the date they are finally published in the Official Gazette.

Who issued the draft Rules, and when?

How quickly must an employer respond to a gratuity claim?

The employer must issue a notice under Form XIII within 15 days of receiving the application, and pay any admitted amount by no later than the 30th day after receipt.

What can an employee do if an employer delays or refuses to pay gratuity?

The employee, nominee or legal heir can apply to the Competent Authority in Form XIV, ordinarily within 180 days of the cause for the application arising.

What is the maternity medical bonus, and when is it paid?

It is Rs. 3,500, payable together with the second instalment of maternity benefit, unless the employer has already arranged free pre-natal and post-natal care.

How much is the crèche allowance if no crèche is provided?
