Dadra and Nagar Haveli and Daman and Diu released a draft notification on 20 July 2026 setting out how the Code on Social Security 2020 will actually work on the ground in the Union Territory. The draft Rules cover the areas that touch employers most often such as gratuity nomination and claims, maternity benefit complaints, employee compensation for workplace injuries, the building and construction worker cess, and the newer employment vacancy reporting duty.

- Establishments and employers covered under the Code on Social Security 2020 that operate within the Union Territory of Dadra and Nagar Haveli and Daman and Diu, including factories, shops and commercial establishments meeting the Code's applicability thresholds
- All employees and workers of covered establishments, including fixed term employees who complete 1 year of service, for gratuity purposes
- Building and other construction workers and their employers, for cess, welfare board registration and BOCW welfare schemes
- Women employees, for maternity benefit, the register of women employees and the Chapter V complaint and appeal mechanism
- Unorganized workers and gig or platform workers within the Union Territory, for registration with and benefits under the Unorganized Workers Social Security Board
- Public sector establishments, for vacancy reporting to Career Centres from the Code's commencement; private establishments once the Government issues a notification
Exempted / special treatment
- Establishments specifically exempted under Section 143 of the Code by the appropriate Government, subject to the conditions attached to that exemption

Are these rules already in force?
No, they are still in draft form. The notification was published on 20 July 2026 for objections and suggestions, and it will only take effect once a final notification is issued after the objection window closes.
Which older laws do these rules replace?
They are set to replace 10 older UT laws, including the earlier Workmen Compensation Rules, Maternity Benefit Rules, two sets of Payment of Gratuity Rules, the Unorganized Workers Social Security Rules 2015, and the ESI Medical Benefit Rules that applied separately to Daman, Diu and Dadra and Nagar Haveli.
What is the objection window and how can objections be submitted?
The window runs for 45 days from the date the gazette copies are made available to the public. Objections can be sent in writing or by email to the Commissioner cum Secretary (Labour) at the address given in the notification.
Do fixed term employees get gratuity under the new rules?
Yes. A fixed term employee becomes eligible for gratuity after completing just 1 year under the contract, paid at 15 days wages for every completed year of service or part year beyond 6 months.
How long does an employer have to respond to a gratuity claim?
The employer must issue a notice in Form VIII within 15 days of receiving the application, either admitting the claim with the amount payable or explaining why it is not admissible.
What happens if an employer does not pay gratuity on time?
The employee, nominee or legal heir can approach the competent authority for a direction to pay. Nonpayment can also attract prosecution under Section 133 of the Code, with imprisonment up to 1 year or a fine up to Rs 50,000, or both.
How does a woman employee complain if maternity benefit is denied?
She, or someone authorized on her behalf, can file a complaint in Form XIV with the Inspector cum Facilitator, who is required to decide the matter within 45 days. An appeal against that decision can be filed in Form XV.
Does an employer need to register the establishment separately?
Yes. Establishments covered by the compulsory insurance provisions under Section 57(1) of the Code must register electronically in Form XIII within 30 days of the relevant notification.
What is the funeral expense deposit and when does it apply?
If a workplace injury results in an employee's death, the employer must deposit Rs 15,000, or a Government notified amount, with the competent authority. This is paid to the deceased employee's eldest surviving dependent, or to whoever bore the funeral costs.
How is the building and construction worker cess calculated and paid?
The cess must be paid within 30 days of the project's completion or the cess assessment, whichever comes first. For projects running beyond a year, it is paid annually on the cost of construction for that period.
Can an employer settle an offence without going to court?
Yes, for a first time offence that qualifies for compounding. The employer can pay the compounding amount within 15 days of the notice using Form XXIII, closing the matter without prosecution.
What records must an employer maintain under these rules?
Key records include the Register of Women Employees (Form XXI), the Notice Book of Accidents (Form XVI), and the Unified Annual Return (Form XXII), among others depending on the establishment's activities.
Do employers need to report job vacancies to the Government?
Public sector employers must report vacancies to the Career Centre from the start. Private sector employers will need to do the same once the Government issues a notification bringing them under this requirement.
