On 12 January 2026, the Labour Department published the draft Rajasthan Code on Social Security Rules, 2026 — a single, consolidated set of procedures for gratuity, maternity benefit, employee's compensation, the Employees' Insurance Court, and the state's two labour welfare boards. It's meant to replace seven older, scattered rule books with one common playbook, built around the central Code on Social Security, 2020.

- All establishments and employers across Rajasthan to whom the Code on Social Security, 2020 applies (Rule 1(2))
- Establishments employing women, who must maintain a Register of Women Employees (Rule 122)
- Employers of employees eligible for gratuity, including fixed-term employees who complete at least 1 year of service (Rule 79, second proviso)
- Employers/establishments engaging building and other construction workers
- Unorganised, gig and platform workers registered with the Rajasthan Unorganised Workers Social Security Board
- Employers and employees involved in accident-compensation, ESI-court or maternity-benefit proceedings
Exempted / special treatment
- Class-wise thresholds and exemptions (establishment size, nature of industry, etc.) are prescribed under the substantive Code on Social Security, 2020 itself, not within these procedural rules — check the relevant Chapter of the Code for exact cut-offs
- Fixed-term employees are treated differently only for gratuity computation — 15 days' wages per completed year (or part exceeding six months), instead of the standard 5-year qualifying period
- Minors, persons of unsound mind, and women (special safeguards for medical examination under Rule 101(6)) receive added procedural protection

What is the Rajasthan Code on Social Security Rules, 2026?
It's a draft set of state-level procedural rules that the Rajasthan Labour Department published on 12–13 January 2026 to implement the central Code on Social Security, 2020. It covers gratuity, maternity benefit, employee's compensation, the ESI Court and two welfare boards in one place.
Has the draft been finalised yet?
Not as of 14 July 2026. It remains a draft — the objection period has run its course, but no final Gazette notification bringing the rules into force had been issued as of this date.
Which older rules will it replace?
Seven existing Rajasthan rules, including the Payment of Gratuity Rules 1973, the Maternity Benefit Rules 1967, the Workmen's Compensation Rules 1960 (and its 1965 occupational-diseases counterpart), the ESI Court Rules 1959, the ESI Medical Benefit Rules 1955, and the Un-organised Workers' Social Security Rules 2011.
Who could file objections, and how?
Any person likely to be affected could send objections or suggestions to the Labour Commissioner at Shram Bhawan, Shanti Nagar, Hasanpura, Jaipur, or by e-mail to lab-comm-rj@nic.in, within 45 days of the Gazette copies becoming available to the public.
How does an employee nominate someone for gratuity under the new rules?
The employee files Form-XI in duplicate. The employer verifies the service particulars and must return the attested duplicate copy within 30 days of receiving it.
How much time does an employer get to respond to a gratuity claim?
Fifteen days from receiving the employee's Form-XII application — the employer must either admit the claim and fix a payment date, or reject it with reasons, using Form-XIII.
By when must gratuity actually be paid once a claim is admitted?
Not later than the 30th day after the employer receives the application, per Rule 80(1)(i).
What happens if the employer doesn't pay gratuity on time?
The claimant can approach the Competent Authority in Form-XIV for a direction. If the employer still doesn't pay after that direction, the claimant can apply in Form-XVII to recover the amount under section 129 of the Code.
Does the draft allow electronic filing?
Yes. "Electronically" is a defined term (Rule 2(1)(k)) covering e-mail, portal uploads and digital payments, and it's used throughout — for nominations, applications, notices and returns.
What is the Unified Annual Return, and when is it due?
It's a single consolidated return (Form-XXXVII) that replaces separate filings under the old rules. It's due on the portal on or before 1 February each year, covering the preceding year's data.
What welfare boards does the draft deal with?
The Rajasthan Unorganised Workers Social Security Board and the Rajasthan Building & Other Construction Workers' Welfare Board — both get detailed rules on membership terms, meetings, allowances and sub-committees.
How are maternity benefit complaints handled?
A written complaint goes to the Inspector-cum-Facilitator (Form-XVIII), who examines records and can direct payment. An aggrieved party can appeal that decision to the Competent Authority in Form-XIX.
What is payable besides compensation if a workplace accident is fatal?
The employer must additionally deposit Rs. 15,000 (or a higher amount the government may notify) with the Competent Authority, to cover the deceased employee's funeral expenses.
Can offences under the Code be compounded?
Yes. An authorised officer issues a compounding notice (Form-XXXVIII), the noticed person can apply and pay the compounding amount within 15 days, and a composition certificate is then issued.
