How will minimum wages be calculated under these rules?
Rule 3 sets a formula based on a fixed calorie intake per person, a yearly cloth allowance, house rent worked out as a percentage of food and cloth costs, and further amounts for fuel, electricity, education, medical needs and other expenses.
What is the maximum number of working hours allowed in a day?
A worker cannot normally be made to work more than 10 hours in a day or 48 hours in a week, and must get a rest of at least half an hour after every 6 continuous hours of work.
Is there a fixed weekly day of rest for workers?
Yes, every worker is entitled to one paid day of rest each week, which is usually Sunday, though the employer may fix a different day for particular employees.
What documents or registers must an employer maintain?
Employers must maintain a wage register in Form I covering wages, advances, overtime, fines and deductions, and a separate employee register in Form VI with details of every worker.
Is issuing a wage slip compulsory for every payment?
Yes, an employer must issue a wage slip in Form VII to every employee at the time of payment or before it, showing the wage period, rate of wages, deductions and net amount paid.
What happens if an employer makes a wrong deduction from wages?
The employer must give written notice of the deduction and the reason for it to the Assistant Labour Commissioner within 10 days. If the deduction is found to be illegal, the officer can hear the matter and take legal action.
How can a worker claim unpaid or short paid wages?
A worker, a registered trade union on their behalf, or the Inspector cum Facilitator can file a single application in Form III before the authority appointed under Section 45 of the Code, asking for the wage difference and any compensation due.
What happens to unpaid wages if a worker passes away or cannot be traced?
If dues remain unpaid for 3 months after becoming payable, the employer must deposit the amount with the Assistant Labour Commissioner, who then pays it to the nominee or legal heir after verifying their identity.
