The Uttarakhand government has proposed the Occupational Safety, Health and Working Conditions Code Rules, 2026 to give effect to the central Occupational Safety, Health and Working Conditions Code, 2020 within the state. Once finally notified, these rules will replace six separate factory era rules that Uttarakhand had adopted from Uttar Pradesh after the states separated, along with the state's own Building and Other Construction Workers Rules of 2005. The draft brings registration, safety committees, safety officers, working hours, welfare provisions for women employees, contract labour licensing, inter state migrant worker protections and factory licensing under one framework, with electronic filing built into most processes.

Have the Uttarakhand OSH Rules 2026 been finally notified?
No. As of August 2026 they remain a proposed draft published on 22 May 2026. The 45 day objection window closed around 6 July 2026 but no final notification has been traced. Employers should confirm current status with the Labour Department.
Which earlier Uttarakhand rules will these rules replace?

How does an employer register an establishment under the draft rules?
By filing an electronic application in Form 3 on the state web portal within 60 days of commencement. The registration certificate is issued in Form A within 7 days, or the establishment is deemed registered if the deadline is missed.
What is the registration fee?
Fees are tiered by worker count, starting at Rs 10,000 for establishments with 10 to 20 workers and rising to Rs 1,00,000 for establishments with 500 to 2,000 workers.
When must a Safety Committee be constituted?
Whenever an establishment ordinarily employs 250 or more employees, or carries on a declared hazardous process or handles hazardous substances, regardless of headcount.
When is a Safety Officer mandatory?
For factories with 500 or more workers, and for factories in hazardous processes or construction sites with 250 or more workers, with additional officers required as headcount grows further.
What is the maximum permitted overtime?
Total weekly hours including overtime cannot exceed 60, and overtime is capped at 144 hours in any quarter of the year.
Can women employees work night shifts under the draft rules?
Yes, before 6 am and after 7 pm, but only with the woman's written consent, and the employer must arrange safe transport, CCTV coverage and full compliance with the POSH Act 2013.
What is the deadline for reporting a fatal accident?
Notice must be sent forthwith by phone, messenger or electronically, and confirmed in writing to the Inspector cum Facilitator and other specified authorities within 12 hours.
How long must registers and records be preserved?
For 5 calendar years from the date of the last entry, and longer if any related case remains pending before a court or authority.
What returns must an employer file every year?
An Annual Return in Form 17 by 31 January, and a Half Yearly Return in Form 18 by 31 July for establishments with a Major Accident Hazard installation.
What is the security deposit for a contract labour licence?
Rs 1,000 for every contract worker covered by the licence, in addition to the prescribed licence fee based on the number of workers.
What journey allowance is due to inter state migrant workers?
A lump sum fare for the to and fro journey home, payable once every 12 months to workers who have completed 180 days of service in the preceding year.
How are offences compounded under the draft rules?
The Compounding Officer issues a notice in Form 48, and the accused must deposit the composition amount within 15 days to avoid prosecution.
Is an appointment letter mandatory for every employee?
Yes. Rule 14 requires every employer to issue a Letter of Appointment in Form 9 before or at the start of employment, covering wage, designation and social security particulars.
